Hello all :)

Hope the year is treating everyone alright.

Had my auction this spring, everything went quite well. - Wondering what to do about a situation :

Bins - At time of sale, auctioneer made it clear that all bins were to be moved off the yard by Aug 1. They have all been moved but one bidder. He bought 6 flat bottoms, and one hopper. The FB's are 3000bu /15' diam with floors, and sweeps. They are westeel wide cores, but I'm thinking they need dismantled before moving. The floors and sweeps for sure...

The buyer doesn't farm; he bought them to resell.....problem is I think he is finding he bought them for at or above market price :)

I called the auctioneer to give this guy a call and a friendly reminder that the bins need to be gone now ASAP

The buyer told the auctioneer I am being a pr&%k and that he will move them when it works for him ( Obviously when he can resell them so that he doesn't have to deal with them).

If it wasn't for wanting to put a building up on the pad where the Flat bottoms are, I wouldn't be so concerned.

Any thoughts or suggestions.

Since maybe he overpaid you might offer to refund some of his $$$ if he has them off by a certain date. You shouldn't have to do this but if it helps??? Depends what it's worth to you. Legal action would be a huge time-waster. He had better sell them soon or it will be too late for this year.

I sold some bins to a guy(verbal agreement) and he never came for them for two years. One week before I was going to put them in a hole he shows up and takes them home! He had not pre-paid and I thought he just didn't want them anymore, some people just have a different schedule....

Glad to hear the sale went well. Might have been a great time to get out of grain-farming, time will tell.;)

What announcements were made sale day? Obviously, they are to be removed by August 1, but was there a stipulation in there if they were not? Maybe check with lawyer on it, and a the minimum send a certified letter to the buyer.

In the letter I would state that the bins are to be removed by September 1 (giving him an extra month) or he as the purchaser shall forfeit all rights to the bins. At that point when September 1 rolls around, they are your baby to do with whatever you want. Sell them again (to be moved immediately) of put them in a hole.

Technically by Aug 1 he is in default and you own them again. I think you will have to give a grace period of a year. It's likely
That he is in a negative position and will never come for them.
The joy of an auction is that people pay to clean your yard. He likely has got wise by now and will ask for refund. Don't budge on the money side but you will have to be patient
